[edit] Description

The Association of Mediators in Bosnia and Herzegovina was established in March 2002, with a purpose of creating conditions for introduction of mediation as an alternative method for dispute resolution in Bosnia and Herzegovina.

The Association wishes to provide citizens with possibility to solve disputes efficiently and effectively and reach agreements which can satisfy all parties in conflict, and help the courts to reduce the backlog and in longer terms reduce the income of cases to the court.

Members of the Association of Mediators in Bosnia and Herzegovina are judges, lawyers, teachers, psychologists, journalists and other professionals, who acquired knowledge and skills to assist others in dispute resolution. There are six trainers with years of experience in mediation, conflict resolution and negotiation in Bosnia and Herzegovina, Serbia, Macedonia and Canada.

[edit] Association of Mediators and Development of Mediation

Establishing of the Association of Mediators in Bosnia and Herzegovina was crucial for introducing mediation as Alternative Dispute Resolution in the country. Since then The Association has been implemented of the idea and activities of creation of legal framework and promotion of mediation. The idea for establishment of the Association of Mediators came from a group of participants of the “Third Party Neutral” programme implemented by the Canadian Institute for Conflict Resolution (CICR) in Bosnia and Herzegovina in 1998. Since then CICR has been a long term partner of the Association.

[edit] Mediation Training

With support of The Canadian International Development Agency (CIDA) and the Canadian Institute for Conflict Resolution (CICR), the Association of Mediators started developing its own mediation training programme in 2004. Four training programmes were designed to educate: mediators, judges and lawyers, end users and trainers. Before these programmes were designed the only mediation training in Bosnia and Herzegovina was the one of the CICR.

[edit] Mediation

In April 2004 the first pilot project was initiated in cases of The Basic Court in Banja Luka, in cooperation with SEED. A year later, the pilot project started in Sarajevo. Until the end of 2006 there were 590 mediations held, of which 330 were closed with settlement agreements, which is about 56% of total number of mediations.

In October 2005 The Association of Mediators in Bosnia and Herzegovina formed a working group to draft the rules on mediation procedure, which would provide conditions for full implementation of The Law on Mediation Procedure countrywide. The Steering Board adopted The Rules in February 2006, after which it started developing related forms.

In November 2006 public call for registration of mediators was opened, which is implemented in the first half of 2007. Upon registration of the first mediators, mediation as a dispute resolution will be available to all citizens in Bosnia and Herzegovina.
