“In a world drawn ever closer by globalization, yet still fractured by historical and cultural division, evolution in conflict resolution management is critical. Thus, we teach our students mediation because it provides a unique perspective on mutual understanding and creative problem-solving. We teach our students the art of negotiation because it is central to both making and saving deals. We teach our students arbitration because it is the global forum of choice for business. Established in 1991, the Dispute Resolution Institute (DRI) offers rigorous academic discourse, hands-on simulation experience, and cross-disciplinary examination of ADR themes in domestic and summer abroad courses for law students, lawyers, and other professionals. DRI's purpose is to educate students in the full range of theory and skills needed to be successful creative agents of conflict resolution and social healing both at home and abroad.

  • Bergen/Oslo Summer Abroad Program: Negotiation and International Organizations, one of two comparative law courses offered in Hamline's Norway Study Abroad program, devotes special attention to Norway's role as an international neutral and explores the dynamics of cross-cultural negotiation.
  • Budapest Summer Abroad Program: Mediation and other Methods to Foster Democratic Dialogue, a joint venture with Benjamin N. Cardozo School of Law, offers students the opportunity to critically examine challenges in the design and delivery of ADR initiatives in both developed and developing democracies.
  • Jerusalem January Term Study Abroad Program: Conflict Resolution from Religious Traditions, a joint venture with Hebrew University of Jerusalem, provides insights into the concepts and methods diverse religious communities use to resolve conflicts.
  • London Summer Abroad Program: Certificate Program in Global Arbitration Law and Practice: National and Transborder Perspectives, a joint venture with Professor Thomas Carbonneau (The Pennsylvania State University, Dickinson School of Law), Editor-in-Chief, World Arbitration & Mediation Report, in cooperation with The School of Arbitration, Queen Mary University of London, provides students with a six credit, four-week rigorous program of instruction in arbitration law and practice.

[edit] Domestic Programs

An unparalleled set of course offerings. In a typical semester, Hamline offers ten or more ADR course, advanced seminars, or clinics, one of the most diverse curriculums in the world.

January Term and Summer Institutes offer a wide array of introductory and advanced courses taught by nationally recognized faculty actively involved in ADR practice, research, and scholarship.

The Certificate Program in Dispute Resolution (CDR). Established in 1996, the fourteen-credit Certificate Program in Dispute Resolution helps students to develop their ADR knowledge and skills in an organized, thoughtful, and scholarly way. Students take a foundation course in conflict theory, complemented by three distinct ADR "process" courses: negotiation, mediation, and arbitration. After this nine credit introduction to theory and practice, students round out their certificate curriculum with five elective credits chosen from a rich array of pre-approved elective courses. Over 150 students are currently enrolled, including a broad cross section of law and other graduate students, practicing lawyers, human resources and business personnel, and other professionals. This intentional variety of students is designed to mirror the contemporary lawyer's work in increasingly multi disciplinary settings.

The Certificate in Advocacy and Problem-Solving (CAPS), a new Certificate designed exclusively for Hamline JD students, seeks to integrate ADR and the day-to-day work of lawyers. CAPS students complete twenty-two credits of study, including three foundation courses (conflict theory, evidence, and negotiation), three process overview courses (mediation, arbitration, and litigation), advocacy practice (clinics, moot competitions, or practicums), and four elective credits (chosen from a rich array of pre-approved elective courses). Each student also writes a capstone research paper, designed and completed with publication in mind.

[edit] Impact Scholarship, Research, And Practice

  • Developing "Second Generation" Global Negotiation Education. A multi-year effort to critique contemporary negotiation pedagogy and create new training designs, in cooperation with the JAMS Foundation, ADR Center, Italy and Negotiation Journal (published by the Program for Negotiation at Harvard Law School).
  • Mediation Case Law Project documents the lessons to be learned from failed mediations and offers innovative teaching videos and case summaries for classroom use.
  • Mediation Center for Dispute Resolution. The DRI praxis arm provides cutting edge consulting, direct neutral services, and sliding fee scale family law mediation services.
  • The Biennial Fall Symposium on Advanced Issues in Dispute Resolution brings together scholars and professionals to engage in purposeful conversation around critical issues in the field of conflict studies and dispute resolution. Symposium proceedings are published in the Hamline Journal of Public Law & Policy.

[edit] Mediation Case Law Project at Hamline University School of Law

On the website of Mediation Case Law Project, you will find the following tools:

  • More than 40 teaching videos produced by Professor Coben and the Minnesota State Bar Association. Each video, typically less than three minutes in length, focuses on a single reported mediation case and attempts to illustrate what went wrong at the mediation that resulted in litigation. Videos are organized by litigation theme: enforcement, confidentiality, sanctions, ethics/malpractice, and miscellaneous. For each video you click on, you will be directed to a short case summary and a windows wmv or quicktime video file. There is no charge for use. The videos present a valuable jumping off point (often "tongue in cheek") for critical discussion of significant mediation issues, suitable for academic classes, mediation training, or continuing education courses.
  • Written summaries of the most significant mediation cases (1999 to today), organized in a variety of user-friendly ways (by type of mediation dispute; alphabetical; by year).
  • A database containing all mediation cases reported on Westlaw where U.S. state or federal judges were forced to decide a disputed issue about mediation (2,219 cases between 1999 and 2005). You can download the database (it's a searchable excel file) and quickly find cases about particular mediation subjects in specific jurisdictions.
