[edit] Description

Based in Rabat, the International Center of Mediation and Arbitration of Rabat (CIMAR) was created on April 28th, 1999, under the initiative of the Chamber of Commerce of Industry and Services of Rabat, with the collaboration of the Ministry of Trade, Industry and the Mines, and the Ministry of Justice. The effective starting of the Center took place during the International Conference on “Arbitration in Morocco: Realities and prospects” organized in Rabat on May 24th and 25th, 2001 by the CIMAR.

The announced vocation of the CIMAR is to promote and reinforce the practices of arbitration and mediation as Alternative Dispute Resolution of legal, commercial and social conflicts in Morocco. In this context, the CIMAR has as main objectives:

  • To organize an institutional mediation or arbitration which is conformed to the rules, laws and regular commercial practices, guaranteeing a fast conflict resolution while preserving the confidentiality of the procedures.
  • To provide the administrative facilities necessary to the arbitrators and mediators, in order to guarantee a fast conflict resolution, through a simple and fast procedure.
  • To spread the culture of mediation and arbitration, in view to make them consider as simple and usual action in the trade and civil practices.
  • To support the economic and social development of the country, in particular to contribute to the drainage of the international capital, by the confidence caused to the national and foreign investors, by the popularization of arbitration and mediation concepts.

For this purpose, the Center offers at the disposal of the parties in conflict:

  • A list of arbitrators and independent, impartial and qualified mediators;
  • A recent resolution of mediation and arbitration fixing the procedure rules to respect and foreseeing the modalities of implementation of these alternative modes of dispute resolution;
  • An administration which ensures the follow-up and the monitoring of the good progress of the procedures.

The CIMAR proposes to the tradesmen and entrepreneurs extra-judicial modes of disputes settlement (mediation, arbitration…) that enable to bring fast - confidential - friendly solutions to their disputes.

The functions of arbitrator or mediator are not exerted by the CIMAR. However, the role of the Center is limited to designate mediators and arbitrators and to monitor the good progress of the procedures.
