[edit] Description

MCFM is a non-profit organization established over twenty years ago by family mediators interested in sharing knowledge and setting guidelines for family mediation. MCFM is the oldest professional organization in Massachusetts dedicated to family mediation.

MCFM serves the public and its members by:

  • Providing information about divorce and family mediation
  • Maintaining a mediator referral directory
  • Publishing the Family Mediation Quarterly
  • Providing continuing education to divorce mediators and other professionals
  • Setting standards to guide the professional practice of mediation
  • Offering a certification program for qualified members

MCFM encourages the parties to discuss the following issues with their mediator.

  • Background and experience of mediator
  • Hourly fees and probable cost of mediation
  • Appropriateness of the mediation process for the parties and alternatives if mediation is not appropriate
  • The use of ongoing legal representation
  • The requirement that each individual provide complete financial disclosure
  • The confidentiality of the mediation process
  • The right of either party to terminate mediation at any time

Family mediation is a non-adversarial process for resolving disputes associated with:

  • Divorce
  • Separation
  • Post-divorce modifications
  • Non-traditional family issues
  • Prenuptial agreements
  • Relationship agreements
  • Estate and other family issues

A family mediator is a neutral, trained individual who helps family members:

  • Create an agreement for their particular circumstances
  • Understand the laws applicable to divorce and separation
  • Negotiate fair and reasonable determination of parental responsibilities, financial obligations and division of property

Family mediation is not psychotherapy, marital counseling or legal representation.Mediators with backgrounds in law or mental health do not represent or counsel mediation clients during the mediation process, but rather serve as neutral facilitators of the decision-making process.
