[edit] Arbitration

Arbitration is a less formal alternative to traditional litigation, offering parties a forum to definitively resolve their dispute with the undivided attention of an Arbitrator. The Arbitrator rules on discovery requests, determines what evidence is admissible and reviews testimony prior to rendering a binding decision.

The three primary forms of Arbitration offered by National Arbitration and Mediation (NAM) are:

  • Open Arbitration, a hearing in which the Arbitrator hears a case and renders a final decision.
  • High/Low Arbitration, a process in which the parties, by agreement, restrict the range of an Arbitrator's decision by establishing "high" and "low" parameters.
  • Baseball Arbitration, which typically involves the submission by each party of his/her last best figure and the reason why it should be accepted with the Hearing Officer's determination being restricted to either one figure or the other.

[edit] Mediation

Mediation is a non-binding, informal settlement conference facilitated by the efforts of one of National Arbitration and Mediation's (NAM's) skilled Mediators. As established by NAM's Rules and Procedures, discussions held during a mediation conference are confidential. The Mediator cannot be called as a witness in any subsequent litigation and any settlement offers made during the conference are not admissible in court.

More than 80% of NAM-mediated cases result in the resolution of all outstanding issues. When a settlement is reached, a Post-Mediation Agreement is signed by the parties and by the Mediator to confirm the mutually agreed-upon terms.

Important Points about Mediation:

  • The Mediator does not render a decision or force the parties to accept a settlement. Each party must mutually agree upon an outcome for a settlement to be reached.
  • All communications in a Mediation are confidential and the Mediator cannot be called as a witness in any subsequent litigation. Additionally, if settlement is not reached, any statements made during the proceedings are inadmissible as evidence in subsequent litigation.
  • Any information disclosed to the Mediator by a party in private caucus will not be revealed to any other party unless permission has been given to do so.

As the acceptance of ADR continues to grow, so has the volume, size and complexity of cases referred to National Arbitration and Mediation (NAM). Many of NAM's clients today oversee ADR initiatives that range from several hundred thousand dollars in resolved cases to more than $100 million per annum.

Given the magnitude of such initiatives, NAM developed myADR, a unique patented dispute resolution case management system designed to help clients oversee their ADR program. myADR is an online portal into NAM's in-house system that provides clients with secure ADR-related data such as case calendars, tracking and status reports as well as decisions and awards.

myADR also acts as an ADR "report card" by providing broad program analyses and case turnaround information so that clients may observe for themselves the superior performance of NAM.
