Description

The Arbitration Institute was established in 1911. Since 1919 it has operated in connection with the Finland Chamber of Commerce in Helsinki.

The Institute does not itself resolve disputes. Instead, it administers the settlement of disputes in domestic and international arbitrations under the Arbitration Rules of the Finland Chamber of Commerce (the ”Rules”) and the Rules for Expedited Arbitration of the Finland Chamber of Commerce (the ”Expedited Rules”). In addition, the Institute may be designated as appointing authority without subjecting the arbitration to the provisions of the Rules or the Expedited Rules.

The Institute may also appoint conciliators in relation to disputes arisen in the conduct of business, provided that the parties agree to this.

The Institute is composed of a Board of Directors and a Secretariat.

MODEL ARBITRATION CLAUSES

Below are model arbitration clauses for parties who wish to submit to arbitration under the Arbitration Rules of the Finland Chamber of Commerce.


Standard arbitration clause: Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or validity thereof, shall be finally settled by arbitration in accordance with the Arbitration Rules of the Finland Chamber of Commerce.

Note: Parties may wish to consider adding:

(a) The number of arbitrators shall be [one / three].

(b) The seat of arbitration shall be [town and country].

(c) The language of the arbitration shall be [ ].


Arbitration clause without Emergency Arbitrator: Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or validity thereof, shall be finally settled by arbitration in accordance with the Arbitration Rules of the Finland Chamber of Commerce. The Emergency Arbitrator provisions shall not apply.
